Privacy policy

Introduction

Privacy and data protection are of utmost importance to us. We are transparent and clear with our clients and other contacts about how we process personal data. We process personal data as securely as possible in accordance with applicable legislation and good legal practice. In this privacy policy (hereinafter referred to as the "Policy"), we provide information on how we process personal data concerning clients, potential clients and other contacts at suppliers and partners.

Data controller

Advokatbyrån Wallin & Partners AB (see our contact details below) is the data controller for the processing of personal data regarding contact persons and others that we receive in connection with assignments or that are otherwise processed when the assignment is prepared or administered and in relation to contact persons at suppliers and partners.

Purpose of processing and legal basis

We process personal data in order to carry out mandatory disqualification and (where applicable) money laundering checks and for accounting purposes. In this case, the legal basis for the processing is that the processing is necessary for compliance with a legal obligation incumbent on us as data controller.

We also process personal data to carry out and administer the assignment, to safeguard your or your employer/client's interests, to administer and manage our relationship with you and your employer/client (e.g. when invoicing or in relation to suppliers and partners) and for news, etc. In this case, the legal basis for the processing is that the processing is necessary for our interest in fulfilling the above-mentioned purposes and that this interest outweighs your interest in not having your personal data processed.

In the case of e-mail correspondence with us, where this contains personal data, we will process the data on the basis that we have or will enter into a contract with the person with whom we have e-mail contact or on the basis that our interest in fulfilling the purposes of the processing outweighs your interest in not having your personal data processed.

If we process data based on consent, specific information will be provided prior to obtaining such consent.

Categories of personal data

As a law firm, we receive and collect many different categories of personal data in connection with our legal activities. In general, we process personal data that we receive from you or your employer/client, but we may also collect such information from general and/or public sources. Such general and/or public sources may be your employer/client's website or from a public authority.

In general, we process the following types of personal data

- name, contact information (email address, phone number, etc.), employer, title, etc.;
- information you provide to us in meetings, trainings and communications;
- personal data that you, or someone else, provide to us in the performance of our legal activities.

Categories of recipients and transfer of personal data

We will not disclose your personal data except in cases where (i) it has been specifically agreed between us and you, (ii) it is necessary in the context of an assignment to protect your rights or those of your employer, (iii) it is necessary for us to comply with a legal obligation or to comply with a decision of a public authority or a court order, or (iv) where we use external service providers to carry out assignments on our behalf.

The data may be disclosed to courts, arbitration boards, authorities, counterparties and counterparty agents if it is necessary to protect your or your employer's rights. We may also transfer data to our suppliers and partners (with these actors we will have the necessary agreements in place).

Duration of treatment

The personal data is saved, in accordance with the obligation incumbent on us as a law firm under the Code of Conduct, for a period of ten years from the date of completion of the case, or the longer period required by the nature of the case. Personal data processed for the purpose of developing, analyzing and marketing the law firm's business is saved for a period of one (1) year after the last contact.

If you unsubscribe from newsletters or similar, the data will be deleted immediately.

Third country transfer

We do not transfer or otherwise process personal data outside the EU/EEA.

Rights of data subjects

You have the right to request information from us free of charge about how we process your personal data. We will, at your request or on our own initiative, correct or erase personal data about you that is inaccurate or misleading or restrict the processing of such personal data. You also have the right to request that your personal data not be processed for direct marketing purposes (if applicable) and to object to such processing (in which case we will cease such processing immediately) or to other processing of your personal data. You also have the right to receive your personal data in a machine-readable format and, where applicable, you have the right to have your personal data transferred to a third party designated by you (data portability).

Automated decision-making

We do not carry out any automated decision-making (including profiling) regarding your personal data.

You always have the right to complain to the relevant supervisory authority.

If you are dissatisfied with - or have concerns about - how we process your personal data, you can file a complaint with a supervisory authority, which in Sweden is currently the Swedish Data Protection Authority (www.datainspektionen.se). You can also contact the supervisory authority in the country where you live or work.

Updating the policy

This Policy has been drafted and updated in May 2018. We reserve the right to update and revise the Policy depending on new legal requirements and how we process personal data. You will be informed if this happens and it is relevant to the processing of your personal data. Please make sure to continuously check if this Policy has changed (an updated version will be available at www.wallinpartners.se).
